IMPORTANT: PLEASE READ THE TERMS AND CONDITIONS OF THESE SERVICE TERMS (AS DEFINED BELOW) CAREFULLY BEFORE USING THE SERVICES.
If you enroll in any of IdentityMaxxPlus products and or our protection products or recovery products you represent and warrant that you are a US resident, that you have provided us your
valid personal information or your family members to be covered by any of our programs with their valid personal information. You agree to keep all Personal Information updated and
accurate. In the event we do not receive all the required Personal Information during your Enrollment Process, you agree that we may, in our sole discretion, use our database, the database
of our affiliates, or other resources to attempt to complete the required Personal Information on your behalf.
We pride ourselves in being able to fix any disputes with our customers through our customer service or arbitration if needed. As last resort we will settle disputes in small claims
court on an individual basis rather than jury trial or class actions.
Both our Privacy Policy and our Website Terms of Use, which apply to our website (our "Site") and your use of our Site, are available here and are incorporated by reference into these
Service Terms. Notwithstanding anything stated otherwise in these Service Terms, the Privacy Policy shall govern with respect to the collection, use, retention or storage of any
information or data provided by you or to which you grant IdentityMaxxPlus access.
You expressly authorize IdentityMaxxPlus, its agents, and its employees to obtain various information and reports about you (or about any minor child that you have enrolled) as we deem
reasonably necessary in performing the monitoring or restoration. We may share your Personal Information with any other person registered on your IdentityMaxxPlus account. You, individually
or as the parent or legal guardian of a minor child you enroll or cause to be enrolled, expressly authorize IdentityMaxxPlus, its agents, and its employees to take any steps necessary to
implement the retortion of your identity. The Limited Power of Attorney allows our Advocates to deal with third parties on your behalf.
You agree and authorize IdentityMaxxPlus, it agents and employees, to provide your personally identifiable information (or information about your child you have enrolled) to third parties
from time to time as provided in our Privacy Policy. You waive any and all claims against IdentityMaxxPlus, it agents and employees for the acts or omissions of these third parties with
regard to the use or disclosure of such information. You further authorize IdentityMaxxPlus its agents and employees to obtain various information and reports about you (or about your
child that you have enrolled) in order to perform our services, including, but not limited to, address history reports, name and alias reports, criminal reports, medical, or any other
relevant reports.
Please note that many of the programs and services offered through the rewards services section of the IdentityMaxxPlus website will have their own terms and conditions and privacy policy
which may different slightly from our site terms and conditions and privacy policy. Before you sign up for these products or services read and agree to their terms and conditions and
privacy policies.
YOU UNDERSTAND THAT BY ACCEPTING THESE TERMS AND CONDITIONS YOU ARE PROVIDING "WRITTEN INSTRUCTIONS" TO IdentityMaxxPlus AND THEIR RESPECTIVE AFFILIATES, EMPLOYEES, AGENTS, SUBSIDIARIES,
AFFILIATES, CONTRACTORS, THIRD PARTY DATA PROVIDERS, AND ALL OTHER CREDIT REPORTING AGENCIES UNDER THE FAIR CREDIT REPORTING ACT (FCRA), AS AMENDED, INCLUDING, WITHOUT LIMITATION, ALL
CREDIT REPORTING ENTITIES, TO ACCESS YOUR CREDIT FILES FROM EACH NATIONAL CREDIT REPORTING AGENCY AND TO EXCHANGE INFORMATION ABOUT YOU WITH EACH SUCH NATIONAL CREDIT REPORTING AGENCY IN
ORDER TO VERIFY YOUR IDENTITY AND TO PROVIDE THE SERVICES TO YOU. WE MAY MODIFY, UPDATE, ADD OR REMOVE PROVISIONS OF THESE SERVICE TERMS AT ANY TIME BY POSTING THOSE CHANGES ON OUR SITE.
UNLESS YOU HAVE OTHERWISE AFFIRMATIVELY AGREED TO SUCH CHANGES, YOUR CONTINUED USE OF THE SERVICES AFTER SUCH POSTING SHALL CONSTITUTE YOUR ACCEPTANCE OF ANY SUCH CHANGE(S) TO THESE
SERVICE TERMS. IF YOU DO NOT AGREE WITH ANY OF THE UPDATED SERVICES TERMS YOU MUST STOP USING THE SERVICES.
As a Member enrolled in IdentityMaxxPlus program should you become a victim of identity theft a member gets emailed and signs a "Limited Power of Attorney, which allows an Assigned Personal
Advocate to restore the members Identity back to pre-theft status. THEREFORE, ALLOWING US TO DO THE WORK ON YOUR BEHALF.
Persons who are eligible for this benefit are called "Members" and include all family persons who reside at the address listed and his or her immediate family (spouses/domestic partner,
dependents under the age of 21 or, if full time students, dependents under 25)
No services will be provided for losses resulting from fraudulent or illegal acts of the registered members and/or customers negligence whether acting alone or in collusion with others
material misrepresentation by members. Further IdentityMaxxPlus and/or its service providers reserves the right to refuse or terminate services where it is deemed that the member is committing
fraud or illegal acts, making untrue statements, or failing to perform his/her portion of the recovery plan.
Identity theft events that pre-date the effective date of the initial term of this contract are excluded from coverage under this program.
Benefits are only available to residents of the United States. In the event of identity theft occurs out of the United States Identity recovery is only performed with agencies and
institutions in the United States or territories where U.S. Law applies
We do not provide credit counseling or repair to credit that legitimately belongs to a member.
Members receive full Identity Theft Monitoring with Realtime Fraud Alerts by Email and Internet Black Market / Dark Web Monitoring. Items that we monitor include: Name, Address, Phone,
Bank Accounts, Credit Cards, Social Security Numbers, Emails, Identity Profiles, Billions of Public / Private Data Records, Criminal Law Enforcement Databases, Millions of Internet Sites,
Chat Rooms, Bulletin Boards, IRC Servers, Social Media, New Groups / Black Market Forums, as needed Medical and IRS fraud.
The provider cannot be held responsible for failure to provide or delay in providing services when such failure or delay is caused by conditions beyond its control. Services do not
cover reimbursement for financial losses of any kind from identity theft recovery services.
Limitation of Liability
YOU EXPRESSLY UNDERSTAND AND AGREE THAT WE AND OUR AFFILIATES, OUR RESPECTIVE LICENSORS, LICENSEES, AND SERVICE PROVIDERS AND OUR THIRD-PARTY SERVICE PROVIDERS OR REWARDS SUPPLIERS
SHALL NOT BE LIABLE TO YOU FOR:
ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL CONSEQUENTIAL OR EXEMPLARY DAMAGES WHICH MAY BE INCURRED BY YOU, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY. THIS SHALL INCLUDE, BUT
NOT BE LIMITED TO, ANY LOSS OF PROFIT (WHETHER INCURRED DIRECTLY OR INDIRECTLY), ANY LOSS OF GOODWILL OR BUSINESS REPUTATION, ANY LOSS OF DATA SUFFERED, COST OF PROCUREMENT OF SUBSTITUTE
GOODS OR SERVICES, OR OTHER INTANGIBLE LOSS; OR ANY LOSS OR DAMAGE WHICH MAY BE INCURRED BY YOU, INCLUDING BUT NOT LIMITED TO LOSS OR DAMAGE AS A RESULT OF:
ANY RELIANCE PLACED BY YOU ON THE COMPLETENESS, ACCURACY OR EXISTENCE OF ANY ADVERTISING, OR AS A RESULT OF ANY RELATIONSHIP OR TRANSACTION BETWEEN YOU AND ANY ADVERTISER OR SPONSOR
WHOSE ADVERTISING APPEARS ON THE SERVICES OR SITE;
ANY CHANGES WHICH WE MAY MAKE TO THE SERVICES, OR FOR ANY PERMANENT OR TEMPORARY CESSATION IN THE PROVISION OF THE SERVICES (OR ANY FEATURES WITHIN THE SERVICES);
THE DELETION OF, CORRUPTION OF, OR FAILURE TO STORE, ANY CONTENT AND OTHER COMMUNICATIONS DATA MAINTAINED OR TRANSMITTED BY OR THROUGH YOUR USE OF THE SERVICES;
YOUR FAILURE TO PROVIDE US WITH ACCURATE ACCOUNT INFORMATION; OR
YOUR FAILURE TO KEEP YOUR PASSWORD OR ACCOUNT DETAILS SECURE AND CONFIDENTIAL.
Disclaimer of Warranties and Limitation of Liability
NOTHING SHALL EXCLUDE OR LIMIT OUR WARRANTY OR LIABILITY FOR LOSSES WHICH MAY NOT BE LAWFULLY EXCLUDED OR LIMITED BY APPLICABLE LAW. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF
CERTAIN WARRANTIES OR CONDITIONS OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR LOSS OR DAMAGE CAUSED BY NEGLIGENCE, BREACH OF CONTRACT OR BREACH OF IMPLIED TERMS, OR INCIDENTAL OR
CONSEQUENTIAL DAMAGES. ACCORDINGLY, ONLY THE LIMITATIONS WHICH ARE LAWFUL IN YOUR JURISDICTION WILL APPLY TO YOU AND OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
OUR SITE, INCLUDING ALL CONTENT, MEMBERSHIPS, PRODUCTS, REWARDS AND SERVICES MADE AVAILABLE ON OR ACCESSED THROUGH THIS SITE, IS PROVIDED TO YOU "AS IS". TO THE FULLEST EXTENT
PERMISSIBLE UNDER APPLICABLE LAW, NEITHER RELIASHIELD NOR ITS AFFILIATES OR ANY THIRD PARTY SERVICE PROVIDERS OR SUPPLIERS MAKE ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND WHATSOEVER
AS TO THE CONTENT, MEMBERSHIPS, PRODUCTS OR SERVICES AVAILABLE ON OR ACCESSED THROUGH THE SITE, THAT A USER WILL HAVE CONTINUOUS, UNINTERRUPTED OR SECURE ACCESS TO OUR SITE, MEMBERSHIPS,
PRODUCTS OR SERVICES OR THAT OUR SITE, MEMBERSHIPS, PRODUCTS, REWARDS OR SERVICES WILL BE ERROR-FREE. IN ADDITION, IDNTITY MAXX AND ITS AFFILIATES AND OUR THIRD-PARTY SERVICE PROVIDERS OR
SUPPLIERS DISCLAIM ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING TITLE, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT AND INFORMATIONAL CONTENT. THEREFORE, YOU
AGREE THAT YOUR ACCESS TO, AND USE OF, OUR SITE, MEMBERSHIPS, PRODUCTS, REWARDS, SERVICES AND/OR CONTENT ARE AT YOUR OWN RISK. BY USING OUR SERVICES AND OUR SITE, YOU ACKNOWLEDGE AND
AGREE THAT NEITHER IdentityMaxxPlus NOR ITS AFFILIATES HAVE ANY LIABILITY TO YOU (WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE) FOR ANY DIRECT, INDIRECT, INCIDENTAL,
CONSEQUENTIAL OR SPECIAL DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH YOUR ACCESS TO OR USE OF OUR SITE, CONTENT, MEMBERSHIPS, PRODUCTS OR SERVICES (EVEN IF WE HAVE BEEN ADVISED
OF THE POSSIBILITY OF SUCH DAMAGES), INCLUDING LIABILITY ASSOCIATED WITH ANY VIRUSES WHICH MAY INFECT YOUR COMPUTER EQUIPMENT.
NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM US, OR THROUGH OR FROM THE SERVICES, SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THIS AGREEMENT.
Payment and Billing
Unless you have cancelled your IdentityMaxxPlus service you agree that you authorize us to bill your credit card or other account that you have designated. We will automatically charge
your credit card on a monthly or annual basis for your recurring monthly or annual renewals, as the case may be, and obtain automatic updates for any expiring credit cards you have
provided IdentityMaxxPlus. Monthly or annual fees and renewal fees will be billed at the rate agreed to upon purchase. At cancellation, your Identity Theft account will be de-activated and
you will no longer be able to log into our Site and/or have any access to the Services or Rewards.
